On Tuesday October 29th, 2024 at about 8:33am Paso Robles Police Dispatch started receiving calls of shots heard in the area of 529 5th street. Just prior to officers arriving on scene a reporting party stated the suspect drove off in a black SUV. Officers checked on a house on 5th street and found several spent 9mm shell casings out front.
A responding officer found the black SUV a block away and noticed someone was trying to hide in the backseat. In the backseat, officers located Francisco GutierrezDeAlba (41, Napa).
GutierrezDeAlba was in possession of an unserialized handgun (ghost gun). He was also under the influence of a controlled substance and very drunk.
As the investigation unfolded, we learned that a female victim was fleeing from GuitierrezDeAlba and drove to Paso Robles to escape. GutierrezDeAlba likely tracked the victim to a short-term rental in the 500 block of 5th Street. Luckily, the victim fled again before GutierrezDeAlba arrived in town. Around 8:30 am, GutierrezDeAlba showed up to the short-term rental, beating on the door, demanding entry. Angry, drunk, and high, GutierrezDeAlba then fired at least 6 rounds from a pistol while outside the home. Fortunately, nobody was hit.
GutierrezDeAlba then drove off.
GutierrezDeAlba was arrested on numerous charges:
646.9(a) PC – Stalking
11550(e) H&S – Possession of a firearm while under the influence of a controlled substance
246.3(a) PC – Negligent discharge of a firearm
23152(g) VC – DUI
GutierrezDeAlba was transported to the San Luis Obispo Sheriff’s Department where he was booked on the above listed charges. Bail was set at $1,000,000.

Note: On the SLO Sheriff’s public “Who’s in Custody” page, it lists one of GutierrezDeAlba’s charges as 246.3(b) PC – Discharge of a BB device with gross negligence. This is a clerical error, as he was booked on 246.3(a) PC – Discharge of a firearm with gross negligence.

Paso Robles, CA – On October 29, 2024, at approximately 8:33 AM, the Paso Robles Police Department received a call from a witness reporting a male yelling in the 500 block of Oak Street. As officers responded, the witness reported hearing multiple gunshots from the area. Officers arriving on scene also heard gunfire as they approached Oak Street.
Upon arrival, officers spoke with the witness, who reported seeing a male leaving the area in a black SUV prior to the officer’s arrival. During a search of the vicinity, officers observed a male entering the back seat of a black SUV parked one block north of the initial location. Officers made contact with the individual, identified as Francisco Gutierrez (41 years old), who was found hiding in the back seat. During the investigation, officers recovered a loaded firearm and spent shell casings from inside the vehicle. Gutierrez was detained without further incident.
No injuries were reported in connection with this event.
Officers also spoke with a female acquaintance of Gutierrez, who may have been involved in a verbal argument with him around the time of the gunfire. It is currently unclear if she was present at the time of the incident.
Investigation Status:
The investigation is ongoing. Gutierrez has been taken into custody and is charged with negligent discharge of a firearm (PC 246.3).
*** ORIGINAL STORY ***
Tuesday October 29th 2024, at 529 5th Street Paso Robles Police Commander Tod Rehner told Paso Robles Incidents / Action that This started as a domestic issue between wife/husband, both who live out of town. The wife was staying in a rental residence, when the husband showed up outside demanding she exit (not sure why they were not together at the rental, or they could have been at some point. Still getting that). At some point, the husband retrieved a handgun and fired numerous shots (into the ground we later found out). When responding officers arrived, they heard an additional set of shots being fired. They located the suspect husband in a vehicle and he was detained. A handgun and a full magazine were recovered at the scene, as well as numerous spent casings. We were able to locate the wife and she is unharmed and at an undisclosed location. We are still piecing this together. Husband has been arrested.
This is still an active investigation, this story will be updated when an official press release from Paso Robles Police Department is available.
